Please read these Terms & Conditions carefully before using the WellPilot platform operated by WellPilot. By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Platform Overview
WellPilot is a Software-as-a-Service (SaaS) wellness practice management platform that enables wellness centers, nutrition clinics, and health coaches to track client body composition, manage member progress, and improve client retention through data-driven insights.
Service Availability
We strive to maintain 99.9% uptime. However, the Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned downtime when possible.
2. User Accounts & Responsibilities
Account Registration
To use WellPilot, wellness center owners must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Roles
WellPilot supports three user roles: Owner, Coach, and Member. Account owners are responsible for managing user access within their clinic, including adding coaches and members, and ensuring all users comply with these Terms.
Data Accuracy
You are responsible for the accuracy and completeness of all data entered into the platform. WellPilot is not liable for decisions made based on inaccurate data input by users.
3. Acceptable Use
Permitted Use
You may use WellPilot solely for lawful wellness practice management purposes. This includes client progress tracking, body composition logging, coach-member communication, and related business analytics.
Prohibited Conduct
You shall not: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorized access to other clinic data; (c) reverse engineer, decompile, or disassemble any part of the platform; (d) upload malicious code or interfere with platform operations; (e) share your login credentials with unauthorized persons.
4. Subscription & Billing
Billing Cycles
Subscriptions are billed on a monthly or annual basis, as selected during plan enrollment. All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes unless otherwise stated.
Plan Changes
You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately, with prorated billing for the remainder of the current cycle. Downgrades take effect at the start of the next billing cycle.
Payment Failure
If a payment fails, we will attempt to notify you and provide a grace period. Continued non-payment may result in service suspension or account termination.
5. Limitation of Liability
No Medical Advice
WellPilot is a practice management tool, not a medical device. The platform does not provide medical advice, diagnoses, or treatment recommendations. Health metrics displayed are for informational purposes only.
Liability Cap
To the maximum extent permitted by law, WellPilot's total liability for any claims arising from or related to the Service shall not exceed the total amount paid by you in the twelve (12) months preceding the claim.
No Warranty
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Termination
By You
You may terminate your account at any time by contacting our support team. Upon termination, your access to the platform will cease, and your data will be retained for 30 days before permanent deletion.
By Us
WellPilot reserves the right to suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in conduct that may harm the platform or other users.
7. Governing Law
Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
